Obamacare-Employer Mandate

Under the new healthcare legislation all employers who employ 50 or more full time equivalent (FTE) workers must provide health insurance to their employees or face a “shared responsibility fee” or tax penalty. A FTE is calculated using both your part time and full time employees. For example 40 part time employees working 15-20 hours per week would correspond to about 20 full time equivalent employees. The employer mandate has been postponed to begin in 2015.

 

The penalty for not providing insurance to employees working over 30 per week will be $2,000 per employee and $3,000 if the employee purchases health insurance through the insurance exchange using premium credits. The penalty is waived on the first 30 employees.
